By accessing this Site and/or making a purchase, we assume you accept these Terms and Conditions in full. Do not continue to use Leaflive.in if you do not agree to all the terms and conditions stated on this page.

1. General Conditions

  • Eligibility: By agreeing to these Terms, you represent that you are at least the age of majority in your state or province of residence and have given us your consent to allow any of your minor dependents to use this Site.
  • Modifications: We reserve the right to update, change, or replace any part of these Terms and Conditions by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes.

2. Products and Pricing

  • Product Descriptions: We strive to ensure that all details, descriptions, and prices of products appearing on the Site are accurate. However, errors may occur. If we discover an error in the price of any goods you have ordered, we will inform you as soon as possible and give you the option of reconfirming your order at the correct price or canceling it.
  • Live Plants: As explicitly stated in our Disclaimer, live plants are unique. The actual plant received may differ slightly in size, shape, and color from the photographs. Minor transit stress is normal.
  • Price Changes: Prices for our products are subject to change without notice. We shall not be liable to you or to any third party for any modification, price change, suspension, or discontinuance of the Service.

3. Orders and Billing

  • Order Acceptance: We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order. In the event that we make a change to or cancel an order, we will attempt to notify you by contacting the email and/or billing address/phone number provided at the time the order was made.
  • Accurate Information: You agree to provide current, complete, and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card or UPI details, so that we can complete your transactions and contact you as needed.

4. Shipping and Delivery

  • Timelines: Delivery times are estimates and commence from the date of shipping, rather than the date of order. We aim to ship orders promptly, but delays can occur due to unforeseen circumstances or courier issues.
  • Risk of Loss: All items purchased from Leaflive are made pursuant to a shipment contract. This means that the risk of loss and title for such items pass to you upon our delivery to the carrier.

5. Returns, Refunds, and Replacements

  • Live Plants: Due to the perishable nature of live plants, we generally do not accept returns. However, if a plant arrives severely damaged or dead, you must contact us at info@leaflive.in within 24 hours of delivery with clear photographs of the unboxing and the damaged plant. We will evaluate the claim and, at our discretion, issue a replacement or store credit.
  • Non-Plant Products: For gardening tools, pots, and unopened fertilizers, we accept returns within 7 days of delivery, provided the items are unused, in their original packaging, and in resalable condition. Return shipping costs are the responsibility of the customer unless the return is a result of our error.

6. Intellectual Property

Unless otherwise stated, Leaflive and/or its licensors own the intellectual property rights for all material on Leaflive.in, including but not limited to the “Leaf Live” logo, product photography, text, graphics, and design. All intellectual property rights are reserved. You may access this from Leaflive.in for your own personal use subjected to restrictions set in these terms and conditions.

You must not:

  • Republish material from Leaflive.in.
  • Sell, rent, or sub-license material from Leaflive.in.
  • Reproduce, duplicate, or copy material from Leaflive.in for commercial purposes.

7. User Comments and Feedback

If you send certain specific submissions (for example, contest entries) or send creative ideas, suggestions, product reviews, or other materials, you agree that we may, at any time, without restriction, edit, copy, publish, distribute, translate, and otherwise use in any medium any comments that you forward to us. We are and shall be under no obligation (1) to maintain any comments in confidence; (2) to pay compensation for any comments; or (3) to respond to any comments.

In addition to other prohibitions as set forth in the Terms and Conditions, you are prohibited from using the Site or its content:

9. Governing Law and Jurisdiction

These Terms and Conditions and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of India. You agree that any legal action or proceeding arising out of or related to these Terms shall be instituted exclusively in the courts located in New Delhi, Delhi, India.
